Firearms Law

Gun owners in California are faced with a nearly incomprehensible web of statutes, regulations, ordinances, and other laws that bear on all aspects of the ownership, possession, and discharge of firearms and ammunition. The complexity of the law virtually requires that gun owners become legal scholars in order to avoid violations of the law when exercising their Constitutional right to keep and bear arms. In fact, law enforcement officers frequently misapply or are simply ignorant of the law as it pertains to the possession and transportation of firearms and ammunition. Even the California Department of Justice has misinterpreted the law to the detriment of gun owners by attempting to promulgate underground regulations in contravention of existing laws. For these reasons, many otherwise law-abiding citizens find themselves subject to prosecution based on alleged violations of the myriad cryptic laws regulating guns, ammunition, and other related items.

Adam Richards has been an attorney with the firm since 2007. In addition to being an avid firearms enthusiast and collector, Mr. Richards has been politically active in the Second Amendment movement since his undergraduate studies. He is currently the plaintiff in a suit in federal court concerning the issuance of permits for carrying a concealed weapon (CCW). * His personal experience and history with firearms pairs with his legal expertise such that he can bring to bear knowledge concerning many firearms offenses including, but not limited to:

  • Possession of assault weapons
  • Importation or manufacturing of high capacity magazines (a.k.a. high capacity clips)
  • Illegal transfers of firearms
  • Possession of destructive devices
  • Unlawful possession/carrying of a firearm
  • Unlawful possession/carrying of a concealed firearm
  • Being a prohibited person found in possession of a firearm or ammunition
  • Possession of a firearm in a prohibited area
  • Brandishing a firearm
  • Discharge of a firearm in a grossly negligent manner or in an unauthorized area
  • Homemade firearms
  • Unserialized firearms

Mr. Richards can also facilitate the return of firearms seized by law enforcement, and assist in applying for a CCW permit or in appealing a permit denial. Furthermore, if you currently have retained counsel, Mr. Richards may consult with and provide legal and technical information regarding firearms to that attorney.
